Expatriates can change employers easily from Jan 2021

7 Jun 2020

From 2021, expatriates working in Oman can switch jobs but only after fulfilling some requirements.
Lieutenant-General Hassan bin Mohsen al Shariqi, Inspector General of Police and Customs, has issued a decision amending some provisions of the executive regulations of the Law on Residence of Foreigners.
According to the decision an expatriate’s resident visa may be transferred from one employer to another who has a license to recruit workers, provided the evidence of the expiry of contract or termination of the employment contract is presented with proof.

The decision will take effect from January 2021. ‘An approval of the competent government authority is required on the second employer’s contract with the expatriate, as per the rules determined by the authority. The transfer of the foreigners’ resident permit shall also transfer the residence of his family members to the new owner,’ the decision stated.

Until the necessary conditions for their residency are met and the transfer procedures are made, the responsibility of the first employer remains valid in everything related to the residence of the foreigner.
Under the current rule, an expatriate worker who is looking to switch jobs in Oman has to procure a NOC to move from one company to another. Should he not receive a NOC, the employee may leave Oman and cant come back until after two years.
